Data protection

We only process personal data (hereinafter mostly referred to as "data") to the extent necessary and for the purpose of providing a functional and user-friendly website, including its content and the services offered there. According to Art. 4 No. 1 of Regulation (EU) 2016/679, i.e. the General Data Protection Regulation (hereinafter referred to as "GDPR"), "processing" is any operation or series of operations carried out with or without the aid of automated procedures in connection with personal data, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or any other form of provision, comparison or linking, restriction, erasure or destruction. With the following data protection declaration we inform you in particular about the type, scope, purpose, duration and legal basis of the processing of personal data, insofar as we decide either alone or jointly with others on the purposes and means of processing. In addition, we will inform you below about the third-party components we use for optimization purposes and to improve the quality of use, insofar as third parties process data under their own responsibility. Our privacy policy is structured as follows: I. Information about us as the responsible party II. Rights of users and those affected III. Information on data processing I. Information about us as the responsible party The responsible provider of this website in terms of data protection law is: Dr. Melanie H. Adamek c/o OPTIMUM Medien & Service GmbH Tumblingerstr. 14 80337 Munich Germany Telephone: 089.5507760 Fax: 089.55077618 Email: mail@melanie-adamek.de The responsible body is the natural or legal person who alone or jointly with others decides on the purposes and means of processing personal data (e.g. names, e-mail addresses, etc.). II. Rights of users and data subjects With regard to the data processing described in more detail below, users and data subjects have the right to confirmation as to whether data concerning them is being processed, to information about the data processed, to further information about the data processing and to copies of the data (see also Art. 15 GDPR; to correction or completion of incorrect or incomplete data (see also Art. 16 GDPR); to immediate deletion of the data concerning them (see also Art. 17 GDPR), or, alternatively, if further processing is required in accordance with Art. 17 Para. 3 GDPR, to restriction of processing in accordance with Art. 18 GDPR; to receipt of the data concerning them and provided by them and to transmission of this data to other providers/responsible parties (see also Art. 20 GDPR) to complain to the supervisory authority if they believe that the data concerning them is being processed by the provider in violation of data protection regulations (see also Art. 77 GDPR). In addition, the provider is obliged to inform all recipients to whom data has been disclosed by the provider of any rectification or erasure of data or restriction of processing carried out pursuant to Articles 16, 17 (1) and 18 GDPR. However, this obligation does not apply if this notification is impossible or involves disproportionate expenditure. Notwithstanding this, the user has a right to information about these recipients. Likewise, users and data subjects have the right to object to the future processing of data concerning them under Art. 21 GDPR, provided that the data is processed by the provider in accordance with Art. 6 (1) (f) GDPR. In particular, an objection to data processing for the purposes of direct advertising is permissible. III. Information on data processing The data you process when using our website will be deleted or blocked as soon as the purpose of storage no longer applies, there are no statutory retention periods that prevent the deletion of the data and no other information is given below regarding individual processing procedures. Server data For technical reasons, in particular to ensure a secure and stable internet presence, data is transmitted to us or to our web space provider via your internet browser. These so-called server log files record, among other things, the type and version of your internet browser, the operating system, the website from which you accessed our website (referrer URL), the website(s) of our website that you visit, the date and time of each access and the IP address of the internet connection from which our website is used. The data collected in this way is stored temporarily, but not together with other data about you. This storage takes place on the legal basis of Art. 6 Paragraph 1 Letter f) GDPR. Our legitimate interest lies in the improvement, stability, functionality and security of our website. The data is deleted after seven days at the latest, unless further storage is required for evidentiary purposes. Otherwise, the data is fully or partially excluded from deletion until an incident has been finally clarified. Cookies a) Session cookies We use so-called cookies on our website. Cookies are small text files or other storage technologies that are placed and saved on your device by the internet browser you use. These cookies process certain information from you to an individual extent, such as your browser or location data or your IP address. This processing makes our website more user-friendly, effective and secure, as the processing enables, for example, the reproduction of our website in different languages or the offer of a shopping cart function. The legal basis for this processing is Art. 6 Para. 1 lit. b.) GDPR, provided that these cookies process data for the initiation or execution of a contract. If the processing does not serve the purpose of initiating or executing a contract, our legitimate interest lies in improving the functionality of our website. The legal basis is then Art. 6 Para. 1 lit. f) GDPR. When you close your internet browser, these session cookies are deleted. b) Third-party cookies Our website may also use cookies from partner companies with whom we work for the purposes of advertising, analysis or the functionality of our website. Please see the information below for details, particularly on the purposes and legal basis for processing such third-party cookies. c) Removal option You can prevent or restrict the installation of cookies by setting your Internet browser. You can also delete cookies that have already been saved at any time. The steps and measures required for this depend on the specific Internet browser you are using. If you have any questions, please use the help function or documentation of your Internet browser or contact its manufacturer or support. In the case of so-called Flash cookies, however, processing cannot be prevented via the browser settings. Instead, you must change the settings of your Flash player. The steps and measures required for this also depend on the specific Flash player you are using. If you have any questions, please use the help function or documentation of your Flash player or contact the manufacturer or user support. However, if you prevent or restrict the installation of cookies, this may mean that not all functions of our website are fully usable. Customer account/registration function If you create a customer account with us via our website, we will collect and store the data you entered during registration (e.g. your name, address or e-mail address) exclusively for pre-contractual services, for the fulfillment of the contract or for the purpose of customer care (e.g. to provide you with an overview of your previous orders with us or to be able to offer you the so-called wish list function). At the same time, we then store the IP address and the date and time of your registration. This data will of course not be passed on to third parties. As part of the further registration process, your consent to this processing will be obtained and reference will be made to this data protection declaration. The data we collect will only be used to make the customer account available. If you consent to this processing, Art. 6 Para. 1 lit. a) GDPR is the legal basis for the processing. If the opening of the customer account also serves pre-contractual measures or the fulfillment of the contract, the legal basis for this processing is also Art. 6 Paragraph 1 Letter b) of GDPR. You can revoke the consent you have given us to open and maintain the customer account at any time with effect for the future in accordance with Art. 7 Paragraph 3 of GDPR. All you have to do is notify us of your revocation. The data collected in this regard will be deleted as soon as processing is no longer necessary. However, we must observe retention periods under tax and commercial law. Newsletter If you sign up for our free newsletter, the data you request for this purpose, i.e. your e-mail address and - optionally - your name and address, will be sent to us. At the same time, we save the IP address of the internet connection from which you access our website as well as the date and time of your registration. As part of the further registration process, we will obtain your consent to send you the newsletter, describe the content in concrete terms and refer you to this data protection declaration. We use the data collected exclusively for sending the newsletter - it is therefore not passed on to third parties. The legal basis for this is Art. 6 Para. 1 lit. a) GDPR. You can revoke your consent to the newsletter at any time with effect for the future in accordance with Art. 7 Para. 3 GDPR. To do this, you simply have to notify us of your revocation or click on the unsubscribe link contained in every newsletter. Contact inquiries / contact options If you contact us via the contact form or e-mail, the data you provide will be used to process your inquiry. Providing the data is necessary to process and answer your inquiry - without providing it, we cannot answer your inquiry or can only answer it to a limited extent. The legal basis for this processing is Art. 6 Para. 1 lit. b) GDPR. Your data will be deleted if your inquiry has been conclusively answered and there are no statutory retention periods that prevent deletion, such as in the case of any subsequent contract processing. User contributions, comments and reviews We offer you the opportunity to publish questions, answers, opinions or reviews, hereinafter referred to as "contributions", on our website. If you take up this offer, we will process and publish your contribution, the date and time of submission and any pseudonym you may have used. The legal basis for this is Art. 6 Paragraph 1 Letter a) GDPR. You can revoke your consent at any time with future effect in accordance with Art. 7 Paragraph 3 GDPR. All you have to do is inform us of your revocation. We also process your IP and email address. The IP address is processed because we have a legitimate interest in initiating or supporting further steps if your contribution infringes on the rights of third parties and/or is otherwise unlawful. The legal basis in this case is Art. 6 Paragraph 1 Letter f) GDPR. Our legitimate interest lies in any legal defense that may be necessary. Subscription to contributions If you publish contributions on our website, we also offer you the option of subscribing to any follow-up contributions from third parties. In order to be able to inform you about these follow-up articles by email, we process your email address. The legal basis for this is Art. 6 Paragraph 1 Letter a) GDPR. You can revoke your consent to this subscription at any time with effect for the future in accordance with Art. 7 Paragraph 3 GDPR. To do this, you simply have to notify us of your revocation or click on the unsubscribe link contained in the respective email. Competition We offer you the opportunity to take part in competitions via our website. If you take part in one of our competitions, the data you entered when participating will be processed without your further consent, but of course only for the purpose of carrying out and processing the respective competition. As part of the processing of the competition, we will pass on your data to the transport company commissioned to deliver the goods or to a financial service provider if the transfer is necessary for the delivery or payment of your prize. If your data is published in the event of a win, you will be informed of this in the declaration of consent. The legal basis for the transfer of data is then Art. 6 Paragraph 1 Letter b) GDPR. You can revoke your consent to the processing of data for participation in our competitions at any time with effect for the future in accordance with Art. 7 Para. 3 GDPR. To do so, you simply have to notify us of your revocation. Facebook is an Internet service of Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA. In the EU, this service is operated by Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland, hereinafter both referred to as “Facebook”. The legal basis is Art. 6 Paragraph 1 Letter f) of GDPR. Our legitimate interest lies in improving the quality of our website. Facebook provides further information about the possible plug-ins and their respective functions at https://developers.facebook.com/docs/plugins/. If the plug-in is stored on one of the pages of our website that you visit, your Internet browser downloads a representation of the plug-in from Facebook's servers in the USA. For technical reasons, it is necessary for Facebook to process your IP address. In addition, the date and time of your visit to our website are also recorded. If you are logged in to Facebook while visiting one of our websites with the plug-in, the information about your specific visit collected by the plug-in will be recognized by Facebook. Facebook may assign the information collected in this way to your personal user account there. If you use the so-called "Like" button on Facebook, for example, this information will be saved in your Facebook user account and possibly published via the Facebook platform. If you want to prevent this, you must either log out of Facebook before visiting our website or use an add-on for your internet browser to prevent the Facebook plug-in from being blocked from loading. Facebook provides further information about the collection and use of data as well as your rights and protection options in this regard in the data protection information available at https://www.facebook.com/policy.php. 1 & 1 IONOS WebAnalytics We use the data protection-compliant analysis tool 1&1 WebAnalytics, a web analysis service of 1&1 Internet SE, Elgendorfer Straße 57, 56410 Montabaur ("1&1"). 1&1 uses its 1&1 WebAnalytics service to evaluate user behavior on our websites and logs the usage data mentioned above. According to 1&1, cookies are not used for this purpose. The information about your use of our websites is usually transferred to a 1&1 server and stored there anonymously. 1&1 compiles anonymous reports on website activities using the usage data determined. According to 1&1, your IP address is also anonymized by 1&1 WebAnalytics and only processed in an abbreviated form to exclude any reference to you personally. We have concluded a contract for order processing (AVV) with 1&1 Internet SE for the web analysis service in accordance with the EU General Data Protection Regulation (GDPR). 1&1 Internet SE thus confirms to its customers that the data is processed securely on the servers of 1&1 Internet SE. This is a web analysis service provided by Google LLC, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter referred to as “Google”. Through certification under the EU-US Privacy Shield (“EU-US Privacy Shield”) https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active, Google guarantees that EU data protection regulations are also adhered to when processing data in the USA. The Google Analytics service is used to analyze the usage behavior of our website. The legal basis is Art. 6 Paragraph 1 Letter f) GDPR. Our legitimate interest lies in the analysis, optimization and economic operation of our website. Usage and user-related information, such as IP address, location, time or frequency of visits to our website, is transferred to a Google server in the USA and stored there. However, we use Google Analytics with the so-called anonymization function. With this function, Google shortens the IP address within the EU or EEA. The data collected in this way is in turn used by Google to provide us with an evaluation of visits to our website and the usage activities there. This data can also be used to provide other services related to the use of our website and the use of the Internet. Google states that it does not link your IP address to other data. In addition, Google provides further information on data protection at https://www.google.com/intl/de/policies/privacy/partners, for example on the options for preventing data use. In addition, Google offers a so-called deactivation add-on with further information on this at https://tools.google.com/dlpage/gaoptout?hl=de. This add-on can be installed with common Internet browsers and offers you further control over the data that Google collects when you visit our website. The add-on tells the Google Analytics JavaScript (ga.js) that information about visits to our website should not be transmitted to Google Analytics. However, this does not prevent information from being transmitted to us or to other web analysis services. You can of course also find out whether and which other web analysis services we use in this privacy policy. Google Analytics Remarketing Our websites use the functions of Google Analytics Remarketing in conjunction with the cross-device functions of Google AdWords and Google DoubleClick. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland. This function makes it possible to link the advertising target groups created with Google Analytics Remarketing with the cross-device functions of Google AdWords and Google DoubleClick. In this way, interest-based, personalized advertising messages that have been tailored to you based on your previous usage and surfing behavior on one device (e.g. cell phone) can also be displayed on another of your devices (e.g. tablet or PC). If you have given your consent, Google will link your web and app browsing history to your Google account for this purpose. This way, the same personalized advertising messages can be displayed on every device on which you log in with your Google account. To support this function, Google Analytics collects Google-authenticated user IDs, which are temporarily linked to our Google Analytics data in order to define and create target groups for cross-device advertising. You can permanently object to cross-device remarketing/targeting by deactivating personalized advertising in your Google account; to do so, follow this link: https://www.google.com/settings/ads/onweb/ The data collected in your Google account is summarized solely on the basis of your consent, which you can give or withdraw to Google (Art. 6 Para. 1 lit. a GDPR). For data collection processes that are not merged into your Google account (e.g. because you do not have a Google account or have objected to the merging), the collection of the data is based on Art. 6 Paragraph 1 Letter f of GDPR. The legitimate interest arises from the fact that the website operator has an interest in the anonymized analysis of website visitors for advertising purposes. Further information and the data protection provisions can be found in Google's privacy policy at: https://policies.google.com/technologies/ads?hl=de Facebook Pixel Our website uses the visitor action pixel from Facebook, Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook") to measure conversions. This makes it possible to track the behavior of page visitors after they have been redirected to the provider's website by clicking on a Facebook ad. This enables the effectiveness of Facebook ads to be evaluated for statistical and market research purposes and future advertising measures to be optimized. The data collected is anonymous for us as the operator of this website; we cannot draw any conclusions about the identity of the users. However, the data is stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes, in accordance with the Facebook data usage policy. This enables Facebook to enable advertisements to be placed on Facebook pages and outside of Facebook. We as the website operator cannot influence this use of the data. The use of Facebook Pixel is based on Art. 6 Paragraph 1 Letter f of GDPR. The website operator has a legitimate interest in effective advertising measures, including social media. You can find further information on protecting your privacy in Facebook's privacy policy: https://de-de.facebook.com/about/privacy/ You can also deactivate the "Custom Audiences" remarketing function in the Advertising Settings section at https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen.
